Ampliação da licença-paternidade dos servidores será regulamentada pelo Estado
A ampliação será de cinco para vinte dias
Em audiência pública realizada na Assembleia Legislativa de Minas Gerais (ALMG), o Governo de Minas, representado pela Secretaria de Planejamento e Gestão (Seplag-MG), sinalizou a regulamentação da ampliação da licença paternidade de servidores estaduais para 20 dias, conforme a Lei Complementar 165/2021. Até então, os servidores que se tornam pais no Estado têm direito a somente cinco dias.
A decisão do governador Romeu Zema de seguir com a regulamentação demonstra que o Governo de Minas é sensível a esta demanda dos servidores, considerada legítima pelo Poder Executivo. Vale lembrar que a concessão da ampliação do benefício não configura um privilégio, pois já é aplicada pelo governo federal para as Forças Armadas e por boa parte do setor privado. A regulamentação da licença-paternidade ampliada para servidores estaduais civis e militares será feita via decreto da Seplag-MG.
Demanda legítima
Durante a audiência, a subsecretária de Gestão de Pessoas da Seplag-MG, Kênnya Kreppel, lembrou que nunca houve discussão sobre o mérito da lei. “Somos sensíveis a esta demanda dos servidores civis e militares, que é legítima. O que faltava para a regulamentação por parte do Estado era uma definição técnica quanto à forma que essa regulamentação aconteceria, se por decreto ou lei específica”, explica.
Isso porque a legislação exigiu uma análise minuciosa da equipe técnica da Seplag-MG e da assessoria jurídica, já que alguns pontos do texto demandariam uma nova lei para serem aplicadas, como a questão de possibilidade de prorrogação da licença-paternidade no caso de falecimento da genitora durante a licença-maternidade.
Além disso, foi preciso destrinchar tecnicamente os impactos financeiros decorrentes da implementação da medida, à luz das restrições impostas pela Lei de Responsabilidade Fiscal.
Contudo, diante da necessidade de ampliação do prazo da licença-paternidade e realizadas as devidas análises técnicas e pareceres jurídicos para não ferir a Lei de Responsabilidade Fiscal, o Governo de Minas já avança internamente no decreto para regulamentar o benefício, que será estendido a todos os servidores civis e militares do Estado de Minas Gerais.
A ampliação da licença-paternidade passará a valer assim que o decreto for publicado. Com isso, os pais servidores terão direito a 20 dias consecutivos a partir da data de nascimento do filho, da assinatura de termo de adoção ou da guarda judicial de fins de adoção de criança.
